The End of Bully Offers

So a couple of weeks ago, something very interesting happend in our industry.  It was announced that no more bully offers will be accepted. 

So, just to give you an understanding....what is a bully offer? 

Well,...a bully offer is an offer that is presented prior to an advertised date where a seller will be reviewing offers.  So, the ethics for both buyers agents AND sellers agents were both questioned whenever a bully offer was presented. 

So, they made this form a couple of years ago called a DIRECTION REGARDING PRESENTATION OF OFFERS which was a document that was part of the listing documents and signed off by the sellers on when they'll be looking at offers

*yeah*

Apparently, it didnt matter that this document was signed because sellers were accepting offers before offer date anyway. All you had to do is go on to your little device and send a message that said

"Got an offer. If your client is interested, write an offer."

This was the only thing you really had to do to negate the DRPO was to inform everyone who was interested.  So really, the document didn't do anything to stop bully offers.  It just created an extra step for realtors to work with bully offers. As you can see, it wasn't really that much of a step.

Then we also saw these kind of  acknowledgements on the internal remarks where realtors are saying that theres an offer date, but the seller has the right to accept an offer before the offer date.

uggghh.

If you're gonna have an offer date, and the seller can look at an offer at any time, then why have an offer date? Just say "Bring your best offer!" 

So now, this DRPO that the seller signed, isn't a legal document at all! It just kinda boggles me that this was the way to eliminate bully offers and it didn't do anything at all!  That document is already a few years old now.

So now....nore more bully offers.  Maybe. We'll see what happens.
